Open Cottage LLC respects intellectual property rights and expects users to do the same. This page describes how to submit a copyright infringement notice under the Digital Millennium Copyright Act (“DMCA”) and how we handle such notices.
1. Designated DMCA agent

Email is preferred for fastest processing. Include “DMCA Notice” or “DMCA Counter-Notice” in the subject line.
2. Filing a DMCA notice
If you believe content on Open Cottage infringes your copyright, please send a written notice that includes substantially the following:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it on the Service (for example, the profile URL and a description of the specific content)
- Your name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Upon receiving a valid notice, we may remove or disable access to the material and notify the user who posted it, as appropriate.
3. Counter-notification
If your content was removed due to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification that includes:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Dallas County, Texas if outside the United States), and that you will accept service of process from the person who filed the original notice
If we receive a valid counter-notification, we may restore the material unless the original complainant files an action seeking a court order, consistent with the DMCA.
4. Repeat infringers
In appropriate circumstances, Open Cottage may terminate accounts of users who are repeat infringers.
5. Misrepresentations
Knowingly materially misrepresenting that material is infringing, or that material was removed by mistake, may expose you to liability under the DMCA. If you are unsure whether material infringes, consult an attorney before filing a notice.
